Yes, the builder will not want to build a load of flats with non-opening
windows as this will affect the market value when they attempt to sell
them. They would rather the windows have openers and then let the
residents complain about the noise.
Not wishing to play devil's advocate, just looking at it from a business
point of view - i.e. a builder will want to maximise profit on their
investment.

We're expecting an appeal so it's not over yet but it's definitely a step
in the right direction and great to know the council really are on our
side.
